Lawyers giving Condo Advice

When you purchase a resale condo suite you receive a Status Certificate that explains the Financial position of the Condominium Corporation.
a) What are they expected to spend Capital Projects (Forward Plan)
b) Are they being sued?
c) Are their Finances stable IE Borrowings vs Special Assessment
d) Percentage of Rentals vs Owners
e) Rules and Regulations you will need to adopt.
f) Is the Owner up to date with their fees and what do they pay
g) Confirmation of Locker and Parking descriptions.

They will provide you all Insurance Documents, Rules and Regulations, and most recent AUDITED Financial Statements.  You now have these on a CD and in Print; You take them to your lawyer....

Lawyer today told a Buyer;  "That condo isn't a good deal because their Annual budget is in deficit."    UMMMmmm Really....  My response?   "Yer stupid".

Building Budget Held Meetings (the Board of Directors and Management Company) for what they expect to spend; planning Diligently. This creates the amount to calculate your maintenance fees.

If we spend $100 more than anticipated on anything ( legal fees, repairs, a few snapped parking control gates)  WE WILL BE IN DEFICIT. 

If a condo is adhering to their Reserve Fund Study, {depositing the correct amount quarterly each year and earning interest}  and the audits have been done.... [by accountants who manage and accounting firms who audit PLUS the engineers who calculate the remaining economic life of system components] there is generally not a lot to discuss.

WTF  [who legal term] are you to decide an annual operational deficit means its a poorly run building and you recommend your buyer skip it.

A financial statement takes a snapshot at a particular calendar date. (Usually Dec 31st year end) Are you overdrawn during TAX time?   Uhhuh   Now pick up that book on accounting practices are review Financial Statements paying careful attention to the Source and Application of Funds.  ( what we collected, what we spent / did with it) 

If the building is deficit or surplus it is carried forward (and paid) into the next year. It is not a VISA card.  Its a running balance.

In this case, the Buyer is changing Lawyers. or the Building could have a sale that show DFT [Deal Fell Through]  when asked the agents would say Financial Statements of the Condo Corp.  Depending on their KLOUT their voices might carry, damaging the financial resale and viability of the building.

Please work with people who understand...  Your road will be so much smoother.

Divorce I'm gonna take everything!

You have heard the battle cry....   I will take everything you have.   The realities and practicalities are vastly different.   A very dear friend and realtor laments in this post better to keep your money.   Take a moment for some sage advice.


The professionals made money from very expensive lawyers, Realtors and right down the line to the appraisers. But get this into your head, it is  your money, but it will be theirs; you have a choice, you can make professionals rich and yourself poor or you can go ahead to get your revenge.

Frankly, the best revenge in the world is to live well – financially, emotionally, physically and spiritually. If you use the system to get your revenge, you will suffer in all fronts ,and when it is all over, too much time will have passed and you will rarely come out ahead.

In the beginning Its all about being a couple. At the end it's about assets, access to children and support.   Read through the advice offered and consider your options.   You can of course embitter your children against the other spouse and drag out the entire process for years. The Lawyers will be pleased you proved "IT" what ever it was.

How will your estate handle conflict?


So many details to consider, and who has the final say;

When testators are considering the persons that they wish to act as their executors and trustees, consideration should also be given as to the manner in which the persons chosen will make decisions in the event that a disagreement or deadlock emerges among them.
Unless the testator indicates otherwise, executors and trustees must make decisions unanimously.  If a testator wishes to appoint multiple executors or trustees, then consideration should be had as to how those persons will make decisions.  Providing for majority decision-making is a common technique that is used in order to address any disagreements that may arise among multiple executors or trustees, but other situations may require other decision-making procedures.

You need to ask and appoint responsible people to deal with your issues and requests.

I recently learned that if appointed, my heirs, would be responsible to conclude your estate. An incredible and time consuming hardship for the unprepared.

How 2 Access your Equity If you Divorce



How You can Access more equity when divorcing!

Yes I do and it is a special niche as I deal with lenders who are in this market segment.





What can clients do when they are divorcing? I know of many women who are looking to buy their own property now.  Can they start all over again & buy another property?


Definitely... With the increasing # of divorces, many of them want 2live separately. However, due to the economic circumstances, some stay together in order to keep the house Others, rent after divorce. Both of which are not good as in the 1st case, they are unhappy living together and the 2nd, it is financially not advisable to rent.


In the traditional way,  when a couple is divorcing, their lawyer is splitting all their assets. There could be times when the couple decides to sell the house and live separately. So what happens then?


What happens is each party ends up with a smaller equity thus, resulting from not being able to buy another property. As you may also know, utilizing a mortgage to Refinance & free up equity can definitely be a great tool when paying out joint matrimonial liabilities, as well as providing a cash settlement. Recent changes in mortgage financing however have now capped accessing home equity to 85% of the property’s value. But I have good news! There are cases where I have been able to assist divorcing couples & their lawyers in negotiating separation agreements. Essentially, the clients are allowed to free up to 95% of the equity in a property specifically for marital splits. That is a huge difference from 85% which is the norm.


So let`s say, for a house valued at $400,000, how much equity they can get?


With traditional lenders, they can only have access to 85%, which = $340,000 in this case. This could be used to pay off one spouse, debts & settlement.  Now compare this vs accessing 95% of the value of the house.


For the same house of $400,000, now they can access $380,000 of equity. This is an extra $40,000. That $40,000 can itself contribute towards a bigger down payment towards a new house. All this is at very good mortgage rates. Divorcees and single parents should really think of owning again rather than renting.

How to Get the word out with Video


You want more people to see your business and last years Yellow Pages is holding up the air conditioner. Lets get some views on your youtube channel. You want fresh eyes!

In the description field for the video ADD a Bit.ly, a URL shortener that will provide a link directly back to your intended landing page.

Use keywords to describe the nature of the video and the primary function of your business. Remember to include your location. Toronto, Ontario Canada

Closed Captioning for Hearing Impaired CC At your youtube account; click the chevron on your name (DROP DOWN MENU) Select Video Manager, then select the video that we will work with by clicking on Edit Video Button. You can now edit anything we need in the Title, ( to better assist with keywords) description or Keyword fields. NOTE we are moving to the Caption Button Field that appears on the TOP row.

Having selected the Captions button a new window will appear with Available Captions or Tracks. Select the + Button to add a Track. New window appears. Select a File to upload. This will be a plain Text file .TXT extension that you have saved in notepad. *This should be an accurate transcribed file of the dialogue. Press upload and you are done.

Remember to turn on the closed caption option in the Footer of the Video frame.

Create your own topical Playlists Touch your name in the top right corner and the drop down menu appears Select Video Manager; on the LH side there is a button to create a playlist however you would like to arrange. +NEW. Either by topic, date, views your choice. Touch the Create NEW and provide a Name and description. Now when you display each video in the view format
