Family Law Court in Ontario is CLOGGED with unrepresented litigants because of the expense of using lawyers.  with that comes a lack of proper process, forms, disclosure, obligations and the ever present; I didn't KNOW I was supposed to do that! 

Can you imagine how our legal systems would be clogged with Self negotiated real estate transactions, private buyers and private sellers neglecting time lines and waiver needs.  Did you cancel that contractor?   Did you pay cash for that roof repair?

At some point DIY and Home Handyman Have some strings attached.  






I'm just reading an article here from Legal Matters, the fact that everyone wants to do everything themselves. I was very surprised, Very Surprised to learn, that in Family Law in Ontario, 75 to 80% of all the work done in court is self represented.

Unrepresented Applicants and Respondants

It makes me understand why long term career lawyers like Stan Gelman [in Mississauga] have opened up "do it yourself" assistance programs.

So we're trying to save money everywhere; by doing everything ourselves.

In the family law case everything is delayed, claimants argue they didn't know, Financial Statements are not done properly, things are handled in a ... [SLOPPY] fashion.  They are not paying attention to the timelines; they are always in trouble with the court. The Judge has to adjudicate the merits of each case that is delayed before they get to mediation or a decision. Transcripts are need and typed. [DARP]

Now WHAT IF  we were to apply those same standards to each and every real estate transaction in Toronto. Let's have every house Sold " For Sale By Owner" and Every Buyer is a By Owner Purchaser, and they are all out on their own arranging their financing, inspections and insurance.

Your Agent is TOO busy to show you a listing?

Well that won't work for me....

Elder Abuse - Toronto Real Estate

This is becoming too common;


MICKEY ROONEY’S ESTATE AND SHEDDING LIGHT ON FINANCIAL ELDER ABUSE

It is not surprising that Mickey Rooney’s estate may become embroiled in litigation.  Mr. Rooney was married nine times; he was survived by a number of children and stepchildren, and was estranged from his current wife at the time of his death. Such full lives often lead to complicated estates.
More troubling was that shortly before his death, Mr. Rooney spoke about being a victim of elder abuse (both verbally and financially) perpetuated by his stepson.  In 2011, Mr. Rooney delivered emotional testimony before the United States Senate about the fear he felt when his stepson, who managed his finances, would lash out at him when he asked questions about missing money or mismanaged investments.  Shortly before his death, Mr. Rooney (through a conservatorship) had reached a settlement with his stepson that involved his stepson paying back over 2 million dollars for misappropriated funds.  It is not known if his estate will now receive any of these funds.
Mr. Rooney, who worked for over 80 years, left an estate valued at just $18,000.00.  He wisely appointed a neutral party, his conservatorship lawyer, as the executor of the estate.  However, the modest nature of his estate does not mean it will remain litigation free. There are already rumblings about a family dispute as were to bury Mr. Rooney.
On the issue of financial elder abuse, a few days ago, the Canadian federal government tabled new legislation, the Digital Privacy Act. One of the goals of the new legislation is to protect seniors from fraud and financial abuse.  The new legislation will allow financial institutions to notify officials or a next of kin if they suspect that an elderly client is the victim of financial abuse.  Currently, bank officials need to obtain the consent of their client before disclosing information to a third party or to continue investigating the matter.
It is too early to predict whether the proposed legislation will have the intended effect. Obviously privacy issues are a great concern.  However, the government is attempting to address the growing fear of financial abuse among Canada’s aging population.



I am fortunate that my training as an Accredited Senior Agent brought many of these issues and situations to light.   I am there to serve the principal in the transaction.  Sometimes that includes involving the lawyers and police.

With so many that are retiring and headed towards nursing homes these issues will become more pronounced.

Estate Sale - Your Sister Hates you

Estate sale. House left to 3 middle aged siblings. Two are well educated, one has a trade. The two were happy, want to sign and with a two week closing. The other one, has it in his head that they are getting cheated. Would not come to the negotiations, had to deal on telephone. Offer good until tonight, this one guy refuses to take phone calls or answer email and is hiding to let this great deal die. We have two offers, with the other being much lower. So, last night, spoke to lawyer friend and my reasonable clients will probably take their sibling to court to have them removed as a co-Executor and to sue for damages.What they can do is simple. I eventually sell the house in the fall, for a lot less money. Take off the loss, the legal costs, etc. They still get their money, as per the first deal but the errant sibling will be solely responsible for the losses and will get their inheritance cut by at least one-third. I have given up trying to talk logic into a non logical mind.
So, is this story about me, a real estate woe? No, it is about the greed and old wounds that come about when their is an inheritance. I told the parties, "this has zero to do with real estate, it has all to do about the family dynamic." Two siblings went off to university and higher academic achievements so now he can get even.


Barry Lebow shared this tale.   I have seen it many times and appreciate being an Accredited Senior Agent, that I have been exposed to these scenarios and how they play out.

They are never about the money or estate but about some forgotten red wagon or Birthday party surprise that caused a LIFE LONG RIFT between siblings.

Are you staring at your neighbour?


Do you believe "ITS" better on the other side?  Do you covet their house?  The Landscaping? Their Curb appeal? Are your kids watching their kids in the tree house? 

When you are looking for a condo; what is the criteria?   Display and presentation?  The ostentatious lobby and double foyer.   But the suites tend to be smallish and less with upgrades. Older is larger.   Maintenance is a concern.

Is it the front lawn and the landscaping.  A Buyer's First Impression that pleases the eyes? Once you are inside that perfect detached home, is their styling exactly as you wish your future home to be?

Before you start comparing features and benefits of homes lets take a moment and discuss  neighbourhoods, transit, schools, a house or worship and distance to your community.  

A wise gentlemen told me yesterday, "The Landscapers charge $2,500 per year to look after the grass trimming, spring and fall clean ups.  That seems expensive since they are in and out so fast. They are many and they have large machinery for the job.   This year we need to have the chimney relined and pointed.   The house is over 50 years old, although it looks great It does need some updating."  He's 88 and still spry.

Back at the condo; I thought about the concierge staff, security, garbage removal, outdoor terrace maintenance and endless BBQs without needing to worry about filling the tank.

Each style has its benefits, Sometimes it looks better over there...

Your lawyer needs to read and obtain a Status Certificate...

A Power of Attorney will be questioned...

Photo ID is not negotiable  We need to comply with FINTRAC.  And NO we do not TAKE CASH because we would need to report you to Canada Revenue.

Not Declaring Rental Income is Evading Taxes...

Flipping properties without living there for a year [post registration] is a FLIP.  Its taxable.

Not everything you read on the internet is the truth....

DEMAND to have your offer presented in person

Ways to empower women

One way to deploy the empowerment of women is through land rights. Land rights offer a key way to economically empower women, giving them the confidence they need to tacklegender inequalities. Often, women in developing nations are legally restricted from their land on the sole basis of gender. Having a right to their land gives women a sort of bargaining power that they wouldn’t normally have, in turn; they gain the ability to assert themselves in various aspects of their life, both in and outside of the home.[4] Another way to provide women empowerment is to allocate responsibilities to them that normally belong to men. When women have economic empowerment, it is a way for others to see them as equal members of society. Through this, they achieve more self-respect and confidence by their contributions to their communities. Simply including women as a part of a community can have sweeping positive effects. In a study conducted by Bina Agarwal, women were given a place in a forest conservation group. Not only did this drive up the efficiency of the group, but the women gained incredible self-esteem while others, including men, viewed them with more respect.[5] Participation, which can be seen and gained in a variety of ways, has been argued to be the most beneficial form of gender empowerment. Political participation, be it the ability to vote and voice opinions, or the ability to run for office with a fair chance of being elected, plays a huge role in the empowerment of peoples.[2] However, participation is not limited to the realm of politics. It can include participation in the household, in schools, and the ability to make choices for oneself. It can be said that these latter participations need to be achieved before one can move onto broader political participation.[6]When women have the agency to do what she wants, a higher equality between men and women is established. It is argued that Microcredit also offers a way to provide empowerment for women.[7] Governments, organizations, and individuals have caught hold of the lure of microfinance. They hope that lending money and credit allows women to function in business and society, which in turn empowers them to do more in their communities. One of the primary goals in the foundation of microfinance was women empowerment. Loans with low interest rates are given to women in developing communities in hopes that they can start a small business and provide for her family.[8] It should be said, however, that the success and efficiency of microcredit and microloans is controversial and constantly debated.[9]

Smarter Mortgage Choices


Let's make smartER Mortgage Decisions

When you bought your home, you thought you were staying a while.  Either you continue with your mortgage to term and renew or you may need more options.

Breaking your mortgage prior to the renewal or renegotiating may involve penalties.  You may have an opportunity to benefit from the new lower rates by renewing now; even with a penalty.

We can Deal with a Renewal or Refinance

If your mortgage is with a Canadian Bank that is federally regulated by Financial Consumer Agency of Canada.(FCAC)  The Bank needs to provide you with a minimum of 3 weeks notice of the Offer to Renew and under what terms and conditions.

You knew this was coming and you should have been shopping around. But there is more here than just the interest rates.  Each Statement, each question posed to the LENDER resulted in additional costs. Now there are discharge fees in addition to Re Registration with another lender; so you need to factually examine your options. Get involved because your mortgage is a major component of your monthly household budget.

Allowing your mortgage to renew automatically does not mean you are getting the best possible terms and conditions.

Switching to a New Lender will require re-document and re- registration. You are in effect applying for a new mortgage and the NEW Mortgage Rules will apply.  Verify exactly what those costs will be.  Your new lender may absorb some of those costs to attract your business. IE Legals, Appraisals, Registration Fees...   Negotiate!

Use an Independent Mortgage Broker that will shop the open market for you to secure the best interest rate and terms for you.  Compare the Mortgage Brokers Offer with the renewal from the Bank. This may be your opportunity to include some higher interest rate debt to lower your monthly payments. 

Your Mortgage Broker can help you understand and read your mortgage documents.  If you have a closed mortgage, you bank may or may not allow you to break the mortgage.  If you are permitted to break the mortgage you will be paying some fees and possibly penalties.

They will tell you if:

  • you need to pay a penalty and what that amount is
  • you need to pay an administration fee
  • you need to pay legal or disbursement fees to discharge the old mortgage
  • you need to pay legal or disbursement fees to register the new mortgage
  • you MUST repay some or all of any “cash back” you may have received when you first obtained the mortgage
  • the calculation of any prepayment penalty would be based on the posted rate at the time you signed your mortgage agreement, or on a discounted rate if you negotiated one for your initial mortgage.

A Mortgage Penalty can be reduced if you make a permitted PREPAYMENT prior to renegotiating.  This would appear counter productive if you are adding in credit card debt or other bills. 

You could renegotiate PRIOR to the Renewal with a Blend and Extend option which simply put will mathematically average the mortgage balance and interest rates. This may be worthwhile if you have a higher interest rate mortgage to combine with Today's low rates.

If you blend and renew at a lower interest rate your payment stays the same; so even with a potential penalty added in to the mortgage balance you may effectively pay it off sooner because of the interest rate savings.

The Decision is yours. A mortgage is often one of the biggest financial commitments you will ever make, so it is worthwhile to do your homework, include knowledgeable and experienced people to help you when you are mortgage shopping, compare the entire package offered by each lender. In seeking the lowest interest rates, consider the features (such as ability to make prepayments or to increase your regular payments) and the services that are important to you and addition fees that may apply.

Unaware Consumers are becoming an Endangered Species


The Endless path of opportunity

"I want to sell my rental property in Etobicoke Ontario. We’d like to find a great agent who won’t bait and switch us with over inflated estimates on what our property is worth or unrealistic time frames to sell it; just to get the listing."

So [insert client's name] sets out like they do in their hunt for any other product or service, digging online. Research.

A Google search for “Etobicoke real estate agent reviews”  provided 30 pages of results:

Not all are local Agents, but aggregators, lead sellers, directories and others who market their way into the keyword search online. Some are companies that just advertise listings.

In 2003

  • We found Buyers with Ads in the paper
  • Our daily Tear Sheets were organised into books by district and price.
  • We were gatekeepers of the LISTING content.
  • Yellow Page Advertising was effective.
  • When Door knocking, more people were home and willing to open the door.
  • Flyers had tangible penetration rates.
  • Direct Mail was effective.

Smart consumers

The Web has birthed a new psychographic known as the Smart Consumer. These are people who dig deep into the data points, content, images, video, news and reviews – the things that drive decisions.  They are either effective in their analysis or paralyzed by the myriad choices. 

Five or even three years ago, you might write these folks off as “obsessed”, “power users” or even “NERDS”. Today, with more and better information available, they’re darn near everybody.

Do you suffer from Impecunity?

My Father gave me a great lesson in life; He told me that while we may sometimes have no money we are never poor because we have our health, our imagination and our spirit to dream.

On this Thanksgiving I can think of no better answer to all our problems, of happiness and worth than to say we have an opportunity to learn and do more to earn money for the things we want [and need].  As long as we are healthy; everything else can be improved on.
