Including a Buyer's Letter

SO many want to include a letter about their family and why they love your house so much;  Why would it be perfect for their family to next occupy your house,  Does it matter?

Should you include a Buyers Letter ?

The "Buyer Letter"

Along with some offers the Buyer's Agent will include a letter from the potential Buyer(s) usually with an 

accompanying photo to plead their case and demonstrate why they should be the one to buy your client's home.

The letter reveals or implies several pieces of information that fall under protected classes as per either the Canadian Charter of Rights and Freedoms or the Ontario Human Rights Act, including age, marital/family status, implied gender and sexual orientation, ethnicity, among others.

Question:

If the Seller(s) use any or all of that information to make their decision about which offer to accept they could be accused of discriminatory practices (so far as I understand). As their Representative what are my obligations, if any, to them once I receive a Buyer Letter?

Am I somewhat justified in counselling them to ignore the Letter and focus solely on the details of the APS submitted?

Multiple Offers Toronto

Multiple offer situations are hard; There can be only one winner.
As a buyer I would always be wondering if there really were other offer bidding on that house.
If I attend the offer presentation; I see the agents line up and wait outside the house, but what if there is no formal offer presentation.
I took the Rules of Etiquette as posted by Brian Madigan and stepped one further.
I posted each AGENT's name, email; and company details on a single blog post. I presume that you can decide if you want to contact the other agents you can [ if they were in person outside a house THEY DO ANYWAYS!]

Multiple Offers by Brian Madigan

Counting the Offers and Advising the Bidders 

The Toronto resale housing market is relatively “hot”. There is a shortage of supply, and quite a few “buyers” for every property.

Offer Day

From the perspective of the Listing Agent, this can present quite a challenge on “Offer Day”.

Frequently, the property will be listed on MLS, the property will be available for showings for several days to permit an opportunity for everyone who has a genuine interest in the property to see it.

The “Offer Date” will be published as well as the time. For example: “offers will be gratefully accepted at 8:00 on Tuesday”.

Legal Notification Requirement

There is an obligation imposed upon Listing Agents in such circumstances to disclose:

1)    The number of Offers,

2)    But, not any of the terms.

This notification is to be provided to everyone who is making an Offer, essentially, that means the Buyer himself. In the case of those Buyers who are represented, then that notification would go directly to their agents.

This is the provision in the Code of Ethics:

Competing offers

26. (1) If a brokerage that has a seller as a client receives a competing written offer, the brokerage shall disclose the number of competing written offers to every person who is making one of the competing offers, but shall not disclose the substance of the competing offers.

(2) Subsection (1) applies, with necessary modifications, to a brokerage that has a seller as a customer, if the brokerage and the seller have an agreement that provides for the brokerage to receive written offers to buy.

The Dilemma

On Tuesday, everyone who has an Offer should know the number. That’s easy when all three Buyers surface by 10:00 am on Tuesday.

However, this is Toronto and the market is very “busy”. Unless the property is an “overpriced dump”, there should be several Offers. But, how many, and when did they come in?

Easily, there could be twenty Offers. When Offer #20 comes in, you can say “you’re one of twenty”. The next step is to contact the other 19. You will also appreciate that occurred with each Offer, other than the first. That’s a lot of phone calls! And, all within a three hour stretch!

Now, it would be easy enough if all the calls were spread out evenly throughout the day. They are not, they all surface within the last three hours.

One other issue is the fact that the Listing Agent cannot refer or make reference to an Offer unless it is actually “received”. That means, the Buyer’s agent has indicated that they have a signed offer in their possession for presentation.

All of this indicates that there are going to be a lot of last minute phone calls.

Delegation to a Receptionist or Assistant

If the Listing Agent has an Assistant, delegating the task of updating the numbers should immediately be assigned to them. The problem is that Buyers’ agents will call the Brokerage, speak to anyone on reception, the Assistant, and/or the Listing Agent. All of these calls will take place within the last couple of hours. So, who is going to make all those outbound calls?

Receptionist

It could be somewhat risky to use the receptionist at a busy brokerage. The larger brokerages will have several people answering the phones, but rarely will they be in a position to place the outbound calls. It could be hectic if several agents have Offer Presentations at the same time, or even on the same day.

The Count

Keeping track of the accurate count among three people, the Listing Agent, the Assistant and the Receptionist is going to be difficult at best.

As the count increase, some will withdraw. There’s method to their madness, they don’t want to unnecessarily bid up the price, because they believe that they may be competitive for the next house.

Advice to all Buyers

Make sure that you inform all of the potential Buyers what method you are going to use to keep them advised of the count. If you don’t, this is a great way to face a disciplinary proceeding and be hit with a $5,000.00 to $10,000.00 fine.

Personal Phone Calls

If the numbers are low enough, this would be the “gold standard”. Everyone gets a personal phone call advising them of the count, directly from the Listing Agent.

Mass Emails by Blind Copy

This works and is manageable for groups of 10 to 15. Each time there is an Additional Buyer, an email goes out to the group advising of the new number. Larger brokerages will often employ this method.

Website Notification

This method of notification can work when things get fast and furious. You would record the count on a webpage for all to see. From the Buyers’ agents’ perspective, it is simple and straightforward. All they have to do is “refresh the page” from their mobile phones. If they were to call the Listing agent, that agent could be tied up with 19 other people, so the call’s going to voice mail.

The Listing Agent can manage this by going into the backend of the website on their mobile device, or alternatively, if they have an Assistant, have that person update the website on a computer.

Dates and times of entry and notification are there for all to see. No one can complain about preferences being given to others.

What to Say

On the webpage, which could be a blog on your own site, or a dedicated page, or even a page on a website dedicated to this particular listing, you should include the following:

123 Main Street- Offers 8:00 pm Tuesday, xx February 201x.

Presentation Format

Using this type of presentation format will ensure that there is no confusion about the numbers and that if one person withdraws, then that is noted. Also, it avoids duplicates, since every “received” Offer is assigned its own number.

Many complaints are associated with the number count and particularly the running tally, when someone withdraws.

You will also notice that there are two Offers which possibly have the “inside track”. One Offer is another agent at the Listing Brokerage. This information needs to be communicated in writing. A phone call won’t do. So, here it is.

The second Offer in contention is from the Listing Agent and there is a one-half percent advantage. This collateral agreement needs to be disclosed including particulars of the extent of the reduction.

Offers “Received”

An Offer is received if its existence is communicated in writing to the Listing Agent by:

1)    Personal delivery
2)    fax,
3)    email, or
4)    text.

As a Listing Agent you may rely upon the underlying truth of the communication. But, that communication has to be in writing. Verbal statements are insufficient.

The communication may be as short as “I have an Offer for you” by TEXT, if you understood from whom it was sent and to which property it applied etc. The Buyer’s representative could also refer to having an 801 Form completed. It could be sent and that also would be sufficient. Even a short text to the effect that there was an 801 signed would work.

Remember, that the key aspect to the Offer being received is:

1)    the Offer exists, and
2)    the Listing Agent has written notice of the Offer’s existence.

Registered Offers

This is, of course, quite different from “registration” of an Offer. In that case, a phone call or other verbal assurance could be made and arrangements made for presentation. This “registered” arrangement takes place without a real Offer having been signed. The Buyer’s representative proposes to have it signed later in the day but wishes to be advised, so that they will be in the loop.

It is not proper to include this Offer in the count until it goes from being “registered” to being “received”.

If you run into problems here, don’t hesitate to retain a Barrister, Solicitor or secure the advice from a lawyer on this point.

What will happen in Toronto Real Estate 2015?

We are bullish and optimistic for the real estate market in 2015 because people consider Toronto ON a destination and an employer.

WHY?

We have first class universities; unmatched health care (PAID FOR) New start up companies are venturing north for technology (WESTERN University and Google in Guelph Kitchener)  Film Industry is strong here!   Our real estate values and Banking Systems are secure and confidant.

Vacancy

As more people arrive in the Toronto GTA Vacancy becomes an issue. Toronto is currently at 1.8% that are vacant even with 20,000 plus units added annually.

The affordability of Condo units as a purchase allows many to move forward to own their own space in Toronto.

Institutional Builders  IE Greenpark, Cadillac Fairview, are not building apartment buildings to add to the rental pool.   The City of Toronto and the Municipal Housing Authority have no budget to repair their existing housing stock. Nevermind building rental inventory.  Two buildings ( Urban Corp ) just converted their projects to rental stock.

How quick did you sell?

It was a dark and stormy night....

You locked your keys in the car. You are holding all your purchases.  It's raining. You called someone to open the car door.  Rescue Me!

You find a service that will do a late night call out to your location; it will take an hour to get there and find you.  You wait impatiently.

They showed up and fix your problem.  Why are you NOW pissed that their job was completed in just 10 minutes and they want $150 just for showing up?

How is the speed of the job related to value?

Often in real estate, when people are selling their Toronto homes [we are firmly in a Seller's Market] I meet with the Vendor's to discuss Selling, Staging, Presentation, Photography and the newest Digital Phenom; Video Marketing.

The sign goes up.

A bevy of people storm through the property.   We are holding offers for seven days.   The Kids are crated and SHIPPED off to granny's house for a week.

Offer night arrives and there are 3 interested parties, panting to Pitch their Clients as new owners.  I ask you to be patient as we interview each agent and ask?   Are they qualified to Buy? Have they been approved for a mortgage?  How Many homes have you seen?  Is this their final and best offer?


In reality everything comes down to Capacity, Ability and Intent to close on the transaction. Do we need to add Seller's Insurance?

GAZUMPING and Pocket Listings

So here we go.... 2014. I learned a great Lesson this year from Leo Bruneau  from Coquitlam BC. We talked at the RE/MAX Kickstart in Toronto just last week. 

GAZUMPING is where you have a real estate agent (REALTOR®) who has verbally agreed to your offer; but when you arrive, show up with all the paperwork signed they took more money from someone else. This is happening!  GAZUMPING



The other thing that's going to happen this year, in West Toronto detached homes sales,
is pocket listings. 

Pocket listings are where a Real Estate Agent takes that listing, keeps it off the MLS for those extra few days or a week, provides it only to his sign calls or to the client database 
that he already has.

This does a big dis-service to the sellers of that property because [they] may have had more money had the home been exposed to the real estate market for a reasonable length of time, to find BUYERS, looking in that pocket but under contract with other brokerages.

You cannot work for the best interest of the seller if you are in your own way.

Winning in a Multiple Offer Toronto

When making a multiple offer on a property we have a form available to Realtors, for the seller to sign, that they have actually seen your offer to purchase.  You will know for certain your offer has been presented.



This may not necessarily get you a sign back, or counter offer, but at least will know for sure that they have been presented with your offer.

I recommend making your offer in person, not by fax or email,  I expect you to be standing nearby, waiting anxiously and including a Letter of Capacity from your bank, that you have the funds available to close on this purchase.

This will make a big difference when compared to other people who are all conditional upon financing and have other obstacles to overcome, like the sale of a property. You can firmly give a date for moving in.

Manufacturing Multiple Offer Senarios

Is it possible to create a situation guaranteed to create a multiple offer Bidding War?

The Toronto real estate market continues to inflame the talking heads screaming about the "end of times" and collapsing values.

Interest Rates will rise but are flat.  Rates have move from 2.5% Variables to Buyers selecting 3.15% five year terms. Has inventory [the number of detached homes in central Toronto] increased? New Buyers arrive every month both from job migration in Canada and those new to Canada. All this adds to the competitive mix.

When pricing a house we take into consideration; proximity to the subject property [your house] How recently the sale occurred, How many improvements and upgrades had been made to that home and ultimately demand for that property in Bloor west, Roncesvalles Village or will you live west and drive from the Kingsway or Markland Wood. See Comparable Market Evaluation.  Access to transit and community have moved up in importance compared to commuting times, gasoline prices and traffic.

So, If we price this property within 2% of where we expect the offers to conclude, and we select a price that is a rounded number [online shoppers are looking for $600 to $650; not $628 to $647,888.]  Do this and you have missed an entire buyer category that may have looked at you but you did not round up or down to catch both the upper and lower limits.  

Some are creating hype in the neighbourhood with POCKET LISTINGS, signs that tease with Coming Soon. This is all to attraction more drive by traffic before the event occurs. Now lets hold offers for 3 or four days prior to examining all the Bidders.  What if Others are making Bully Offers;  take me now. You may not get it later. 

Are the Buyers falling for this?  Or Do you as an informed consumer say; "That house is priced $100,000 below the last sale. I know there will be a bidding war and I will not go that far past their expectation" . I have also had and advocate the "There will be another house equally suitable."  

Some SELLERS have an expectation that sealed bids will somehow appear in their mailbox at 10:00 PM at night.  Drivers (REALTORS) will stealthily approach and drop their 11 page document with a Confirmation of Representation and You have seen my Offer and rejected it page. SERIOUSLY. Some doors no longer have a mail slot. This is simply not happening. Agents call and Register their offer with the Listing Brokerage.  Offers are presented (usually in person) in the order of registration.  Enough copies are on hand for acceptance and signatures. 

The agent has a responsibility to present all offers to you. You have the option of Signing back, rejecting or accepting the offer. Sometimes you have good offers on the table and your agent sends them all away for a final round [to top up your best bid] and no one returns.  Sometimes the appointed offer time arrives and passes, unanswered.

Can you create a Bidding War?   Although there may be multiple potential buyers for that property, each house is unique and may just not create that multiple offer scenario.  You are better off pricing the home properly for sale, than undervaluing your largest asset hoping for enthusiastic Buyers.  Most of all remember, Your home must pass inspection and appraisal post the sale and prior to closing.

Holy Sh**! I would have paid that


When you are in a multiple offer situation and you are unclear of your direction;  here is some wonderful advice I recently absorbed.    


  • Is you offer so good that the Buyer's will Say   Holy Sh**!
  • Once you find out how much the house sold for, Is your response "Holy Sh**! I would have paid that!

In an effort to Aide transparency  RECO is amending and adding clauses to REBBA

 On April 18, 2013, the Minister of Consumer Services proposed new legislative amendments to the Real Estate and Business Brokers Act, 2002 (REBBA) through the Stronger Protection for Ontario Consumers Act. This proposed legislation would apply new rules for the real estate sector that would affect both REALTORS® and consumers.The proposed legislation consist of:
  • Requiring real estate salespeople and brokers acting on behalf of a buyer to only present offers in writing
  • Requiring the brokerage acting for the seller to retain copies of all written offers received, providing clarity for buyers and sellers
  • Allowing home sellers and buyers to negotiate a combination of fees and commissions with a real estate professional, tailoring the cost with the services consumers want

In a recent Multiple offer situation;  once we selected the final bid, I had  copies of the other offers to display to the BIDDER. There is nothing wrong with honesty and disclosure.

Are you willing to pay more because of staging?

In Toronto's competitive real estate market agents are recommending staging to get Buyers to pay the highest dollar for a property.  They stage and craft every detail, with a single goal.  Hold offers to create a frenzy. Possibly underprice to garner additional attention. Why?  To engage you emotionally with house.


"See! This is how it could be if you lived here."


So on the average sale of $650,000  in competition you might add on $50 - $75,000.


That is a lot of lipstick and paint that you can buy later.


Rather than mortgaging furniture and pillows that were rented;

  • Lets look for a property that has been on the market a little longer.
  • Suffers from Divorce or Financial Stress
  • Visible deferred Maintenance Issues
  • Mom or Dad has been moved out and it needs a facelift.
  • Needs a bathroom or Kitchen remodel.
  • You will be painting anyways
  • You will find neglected and masked repairs.
  • You will be making renovations.



Lets put your money to better use.  Buying you, your Dream Home within your budget and where you can have the mortgage paid off sooner.


That's what its really about..  Not conspiring to cost your more.
